So I heard what happened to Fighting is Magic



Just saw an article on EqD bearing ill news about Fighting is Magic. And it has me a bit concerned for the sake of Spikes Quest.

Not that this game would had ever competed with the awesomeness that would had been Fighting is Magic, but I still had some pretty wild ambitions for this game. But if legal issues are a huge threat to such projects then I have to question the stability of the production path for SQ.

Should I be afraid of the potential Cease and Desist notices from Hasbro? Should I maybe discontinue the use of their IP and try something a bit more... original?

I'm a bit on the fence here.

    ejehm... well, now what i deeply think:

    i think the problem with FIM was the trademark, and that my friend, is the use of the name of a product to produce such product, if someone else uses it, the owner of the product must defend it, so, as long as you dont use ''my little pony'' on the name of YOUR product, then you wont have such a problem, another thing is copyright, that is, the use of content from the product, so lets see, as far as i know you are not using ''my little pony'' instead, you are using ''spikes quest'' that is not trademark (which is seriius business) that is copyright (which hasbro tends to be a little tolerant with) and the only thing you are using from the trademar is spike, nothing else XD

    so i recommnend not using names or characters form the show, especially in the name of the product, use little, just using spike's sprite would be fine, i believe

  2. Fighting is Magic fell because the team spent too much time hyping the game and acting like a real company rather than a group of fans, and didn't release anything until it was too late. For fan-games and other fan-projects risking legal issues it's either stay as low-profile as possible or have public releases often so there's no chance of the work being destroyed suddenly in one day. If you choose to continue this as a My Little Pony fan-game, you'll want to keep that in mind.

    If you do drop the use of the MLP trademark, I'm sure you can shape the current form of the game into something new and original, especially since it's fairly far from the general content of the actual show. Plus, you could potentially gather more interest since you'd be releasing it to a more broad audience, and with that, more support for the game. There's also the satisfaction of creating a completely original product over making something using someone else's preexisting assets. You'd even be able to profit off it if you'd like. All by avoiding a legal issue.

    I'd personally take the safer route and make something original, but of course it's all up to you.

    1. Nothing too serious, really. Just trying to figure out what I need to do for this project :P

      I'm having a few issues getting back into the main code again and so I'm debating with myself whether I should just reboot the whole thing or start working through the giant knots of code that I have here now to make things work.
